Privacy Policy

The protection of Internet Winds AG. S.A. clients’ privacy (hereinafter “iWinds”), with registered office at calle 5 number 592, city of La Plata, province of Buenos Aires, and the security of their information are considered a priority for our organization.

This privacy policy (hereinafter the “Policy”) is published on the following iWinds website: www.iwinds.com.ar, and shall be considered known and expressly accepted by individuals or legal entities that acquire the service(s) provided by iWinds (hereinafter the “Client(s)”).

The purpose of this Policy is to inform Clients, in a clear, concrete and detailed manner, about the collection, use and processing of their information, as well as the protection of their personal data in accordance with law 25.326 (personal data protection), its regulatory decree, complementary rules and provisions issued by the Agencia de Acceso a la Información Pública (Public Information Access Agency).

All information iWinds receives from its Clients shall be duly safeguarded and may not be communicated, modified or disclosed except in the cases foreseen in this Policy or as provided by current legislation.

iWinds reserves the right to modify the Privacy Policy, which will be published with the corresponding update date.

Definitions

Personal data: Information of any kind referring to individuals or legal entities, determined or determinable.

File, record, database: Indistinctly, they designate the organized set of personal data subject to treatment or processing, electronic or otherwise, whatever the modality of their formation, storage, organization or access.

Data processing: Systematic operations and procedures, electronic or otherwise, that allow the collection, preservation, ordering, storage, modification, relating, evaluation, blocking and destruction of personal data, as well as their assignment to third parties through communications, consultations, interconnections or transfers.

Data controller: Individual or legal entity, public or private, that owns a file, record or database.

Computerized data: Personal data subject to electronic or automated treatment or processing.

Data subject: Any individual or legal entity with legal domicile or delegations or branches in the country, whose data are subject to treatment in accordance with current legislation.

Data dissociation: Any processing of personal data such that the information obtained cannot be associated to a determined or determinable person.

Data assignment: Any disclosure or communication of data made to a person other than the data subject.

Personal Data Protection Principles

Property right over personal data: the most important principle established by law 25.326 is that data, regardless of where it is stored or how it is being used, always belongs to its owner, who has the right to control how their personal information is used.

Lawful data file: as established by arts. 3 and 6 of law 25.326, iWinds, with registered office at calle 5 number 592, city of La Plata, province of Buenos Aires, duly complies with the registration of its Partners’ database with the Public Information Access Agency, in accordance with current regulations.

Data quality: iWinds uses adequate technology and well-defined personal practices to process Clients’ personal data. iWinds does not collect data for any purpose other than or incompatible with the purpose stated in this Policy, nor by disloyal, fraudulent means or in a manner contrary to current legal provisions. The data we collect must be true, adequate, pertinent, exact and not excessive in relation to the scope and purpose that motivated their collection. They will be stored in a way that always facilitates the exercise of their owners’ rights, updated where necessary, and destroyed in accordance with the current regulatory framework.

Data category: no one may be forced to provide sensitive data. iWinds does not collect or process that category of data.

Information and consent in data processing: iWinds only processes personal data with the free and express consent of their owners and solely for the purposes iWinds has informed in accordance with applicable law.

Security: iWinds implements all measures necessary to maintain the security of Clients’ personal information, contemplating the practical, technical and internal organizational measures needed to guarantee the security, integrity and confidentiality of data, diligently working to avoid unauthorized access, destruction, use, modification or disclosure of data, in accordance with art. 9 of law 25.326, complementary rules and in particular Provision 11/2006 of the Personal Data Protection Directorate, which establishes the different security measures for the treatment and conservation of personal data contained in private databases.

Duty of confidentiality: iWinds undertakes to maintain the duty of confidentiality of personal data, which may be released from such obligation by law, or a judicial ruling issued by a competent authority.

Right of information: Clients may consult the Public Information Access Agency (or the supervisory authority that replaces it in the future), free of charge, about the existence of files, records or databases, their purposes and the identity of their controllers. That agency is in charge of the National Database Registry, which is public and free of charge.

Right of access: the right that allows the data owner to know whether or not they are included in a database; all data relating to them included in that database; the purpose of the treatment and any assignees of the information. The owner may access the data collected by iWinds by sending an email to ventas@iwinds.com.ar with the subject “Right of Access” from the email address provided when giving their personal data, and stating the medium by which they wish to be given such access (e-mail, postal mail, in-person delivery, phone).

Right of information: the right that allows any person to request information from the Public Information Access Agency about the existence of databases, their purposes and the identity of their controllers.

Right of rectification, updating and deletion: the rights that allow any person to correct false, erroneous, incomplete or incorrect information in a database. The owner may exercise these rights by sending an email to ventas@iwinds.com.ar specifying the data to be rectified, updated and/or deleted. iWinds reserves the right to require the owner to send proof of their identity.

Purposes of Collection

The collection and automated processing of Clients’ personal data has the following purpose:

PRIMARY PURPOSE: individualization of the client and the technical, administrative management and provision of the services offered by iWinds contracted by the Client, such as: 1) activation and/or deactivation of Hosting Plans or Accounts for Websites, 2) .com Domain Registrations, 3) related services that may be offered and published on the website www.iwinds.com.ar.

SECONDARY PURPOSE: sending email by iWinds to the email address supplied by the Client, with commercial and technical information about the services contracted by the Client with iWinds via the web. It also includes sending survey forms and questionnaires by email that the Client is not obliged to answer. iWinds gives the Client the option to stop receiving information by email. This can be done by sending an email to ventas@iwinds.com.ar.

Assignment of data to third parties

The data owner gives their express and informed consent for iWinds to assign the collected data to third parties with which it maintains agreements, in order to fulfill its corporate purpose. At all times the owner shall have the right to revoke their consent for the assignment of their data by sending an email requesting revocation to ventas@iwinds.com.ar.

Use of Cookies

iWinds may use cookies on its website: “cookies” are small text files that websites you visit store on your computer’s hard drive. iWinds may use cookies to improve your experience when you visit us, making the website work more efficiently by remembering, for example, your preferences or language.
You may configure the program you use to browse the Internet so that it warns you before accepting cookies. You may also configure the program to disable the use of cookies. However, this could limit access to some of the features of this or other websites.
You may also delete the cookie files stored on your computer. To do so, consult the manual of the software you use to browse the Internet.

Links to other Sites

iWinds websites may contain advertising or other content that establishes a link to third-party websites or services, some of which may request information about users and/or use technology for the collection and storage of data. Although iWinds does its utmost to prevent Personal Data about Clients from being collected without their consent, within our technological capabilities, it is impossible for us to control their contents or the links they in turn offer, since many of them are permanently modified and have their own privacy policy. Clients acknowledge and accept that iWinds cannot control the actions and/or violations that the aforementioned websites may commit. Therefore, we advise that before providing any kind of information to a linked website, you verify the privacy policy it applies; our websites are not responsible for any damage those websites may cause, nor do we adhere to the privacy policies of those websites that contravene our own principles.
